1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Tutix ("we," "our," or "us") governing your access to and use of the Tutix web application at tutix.ai (the "Platform"), including all content, features, and services offered through the Platform.

By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Platform.

2. Description of Service

Tutix is an AI-powered learning platform that provides the following services (collectively, the "Services"):

• Structured courses: Pre-built catalog courses with interactive lessons, progress tracking, and mastery analytics. The live catalog currently includes Cambridge IGCSE: Add Maths, Physics, Chemistry, and Maths; AP: Human Geography.
• Custom courses: User-created courses generated from uploaded PDFs or topic descriptions, with AI-generated blueprints, entities, and study materials.
• AI tutoring: Real-time AI-powered tutoring via Canvas (whiteboard with Gemini Live audio/video), AI Chat, and Textbook Chat, providing personalised explanations and guided problem-solving.
• Study tools: AI-generated and user-created flashcard decks with spaced repetition, quizzes with detailed analysis, study notes with AI summarisation, and revision sessions.
• Challenge modes: Sprint-Off (timed rapid-fire) and All-In (comprehensive) challenge sessions to test and reinforce knowledge.
• Learning intelligence (Cog+): An adaptive system that tracks mastery, identifies weak concepts, generates personalised learning plans, and provides study recommendations.
• Analytics and progress: Statistics dashboards, activity heatmaps, leaderboards, monthly progress reports, and data export.

3. Account Registration and Eligibility

3.1 Eligibility

You must be at least 13 years old to create an account. If you are between 13 and 17, you must have the consent of a parent or legal guardian who agrees to these Terms on your behalf. We reserve the right to request verification of parental consent at any time.

3.2 Account Security

When you create an account (via email/password or Google Sign-In), you agree to:

• Provide accurate, current, and complete registration information.
• Keep your login credentials confidential and not share them with any other person.
• Notify us immediately at [email protected] if you suspect unauthorised access to your account.
• Accept full responsibility for all activity occurring under your account.

We are not liable for losses arising from unauthorised use of your account where you have failed to maintain the security of your credentials.

4. Subscription Plans, Payments, and Billing

4.1 Plans

The Platform offers multiple subscription tiers with different usage allowances:

• Free: No-cost access with limited monthly AI jobs, AI chat messages, uploads, canvas minutes, and no custom course creation.
• Pro: Expanded monthly allowances, premium study tools, monthly summary reports, and 1 custom course per month. Available as monthly or annual billing.
• Pro+: Higher allowances across all categories, monthly summary reports, and 3 custom courses per month. Available as monthly or annual billing.
• Pico (usage-based): Premium study tools with usage-based pricing for AI/chat/uploads/canvas and 20 custom courses per month.

Current pricing, feature comparisons, and usage limits are displayed on our Pricing page. Where we offer one-time purchases, they will be shown clearly at checkout.

4.2 Billing and Renewal

• All payments are processed securely by Stripe. We do not store your full card details.
• Paid subscriptions renew automatically at the end of each billing cycle (monthly or annually) at the then-current rate unless cancelled before the renewal date.
• For usage-based billing, eligible usage is deducted from wallet balance at the published PAYG rates. When balance is insufficient, further wallet-funded usage may be paused until funding is restored.
• We reserve the right to change pricing with at least 30 days' notice to existing subscribers. Price changes take effect at the start of your next billing cycle after the notice period.

4.3 Cancellation and Refunds

• You may cancel your subscription at any time via Account Settings → Billing → Manage Subscription (Stripe Customer Portal). Cancellation takes effect at the end of your current billing period; you retain access to paid features until then.
• We offer a 30-day money-back guarantee for first-time paid subscriptions. If you are unsatisfied within the first 30 days, contact [email protected] for a full refund.
• After the 30-day period, refund requests are evaluated on a case-by-case basis. You may submit a refund request from your Order History page.
• Unused wallet balance is non-refundable except where required by law.

5. Acceptable Use

You agree to use the Platform lawfully and in accordance with these Terms. You must not:

• Use the Platform for any purpose that violates applicable law or regulation.
• Attempt to gain unauthorised access to any part of the Platform, other users' accounts, or our infrastructure.
• Reverse-engineer, decompile, or disassemble any part of the Platform's software or AI models.
• Use automated scripts, bots, scrapers, or other programmatic means to access the Platform without our prior written permission.
• Circumvent or attempt to circumvent rate limits, usage quotas, or access controls.
• Upload content that is illegal, infringing, defamatory, obscene, malicious, or that contains viruses or harmful code.
• Share, resell, or sublicense your account or access credentials.
• Use AI-generated content from the Platform to create competing educational products or services without our written consent.
• Intentionally submit prompts designed to cause the AI to produce harmful, misleading, or illegal content.
• Interfere with or disrupt the Platform's functionality, servers, or networks.

We reserve the right to investigate suspected violations and to suspend or terminate accounts that breach these rules, with or without notice depending on severity.

6. Intellectual Property

6.1 Our Content

All Platform content, including but not limited to course materials, lesson text, generated entities, software, UI design, logos, trademarks, and documentation, is owned by or licensed to Tutix and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content except as expressly permitted by these Terms or with our prior written consent.

6.2 Your Content

You retain full ownership of content you create on the Platform (notes, flashcards, uploaded PDFs, custom course descriptions, canvas drawings, chat messages). By using the Platform, you grant us a non-exclusive, worldwide, royalty-free licence to store, process, display, and transmit your content solely for the purpose of providing and improving the Services. This licence terminates when you delete your content or account, except for copies in our encrypted backups (which are purged per our retention schedule).

6.3 AI-Generated Content

Content generated by the Platform's AI features (quiz questions, flashcard answers, explanations, learning plans, canvas annotations) is provided for your personal educational use. We make no claim of copyright ownership over AI-generated output. However, AI-generated content may occasionally be inaccurate, incomplete, or misleading. You are responsible for verifying the accuracy of AI-generated content before relying on it for academic or professional purposes.

7. Service Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted or error-free operation. We may:

• Temporarily suspend access for scheduled maintenance, security updates, or infrastructure changes, with reasonable advance notice where practicable.
• Modify, discontinue, or deprecate specific features or services. Where a change materially reduces the functionality of your paid plan, we will provide at least 30 days' notice and, at our discretion, offer a pro-rated refund or credit.
• Update AI models, which may change the style, quality, or format of AI-generated content without notice.

We are not liable for any loss, damage, or inconvenience caused by downtime, feature changes, or AI model updates.

8. Disclaimers

• The Platform and all Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not guarantee that the Platform will meet your specific learning objectives or lead to any particular academic outcome, exam grade, or certification.
• AI-generated content is produced by machine-learning models and may contain errors, biases, or hallucinations. It is intended as a learning aid, not a substitute for professional instruction, textbooks, or official curriculum materials.
• We do not warrant the accuracy, completeness, or reliability of any third-party content, links, or integrations accessible through the Platform.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• Our total aggregate liability to you for all claims arising from or relating to these Terms or your use of the Platform shall not exceed the greater of (a) the total fees you paid to us in the 12 months preceding the claim, or (b) £100.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, loss of goodwill, or loss of opportunity, even if we have been advised of the possibility of such damages.
• Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Tutix, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform in violation of these Terms, (b) your violation of any applicable law or third-party right, or (c) content you upload or create on the Platform.

11. Termination

11.1 Termination by You

You may close your account at any time via Account Settings → Delete Account. Upon deletion, your data will be purged in accordance with our Privacy Policy. Active subscriptions should be cancelled before account deletion to avoid further charges.

11.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you:

• Breach any material provision of these Terms.
• Engage in fraudulent, abusive, or illegal activity.
• Fail to pay applicable subscription fees after reasonable notice.
• Use the Platform in a way that poses a security risk to other users or our infrastructure.

Upon termination, your right to access the Platform ceases immediately. Sections 6, 8, 9, 10, 12, and 13 survive termination.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-law principles.

Any dispute arising from or relating to these Terms or the Platform shall first be attempted to be resolved informally by contacting [email protected]. If informal resolution fails within 30 days, either party may submit the dispute to the exclusive jurisdiction of the courts of England and Wales.

13. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tutix regarding the Platform and supersede all prior agreements.
• Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
• Force Majeure: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, war, government action, or internet service disruptions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will notify registered users by email at least 14 days before the changes take effect and post a notice on the Platform. The "Last updated" date at the top indicates the most recent revision. Your continued use of the Platform after the effective date constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the Platform and close your account.
